Looking back: GeschGehG 2022

To wrap things up, let’s take another look at the activities of the Geheimnisblog over the past year:

We published no fewer than 13 posts related to the German Act on the Protection of Trade Secrets (GeschGehG) in 2022, including several articles on recent court rulings concerning protective measures, reverse engineering, as well as cocktail recipes, and the first Federal Court of Justice (BGH) decision on the new procedural confidentiality provisions of Sections 16 and 19 of the GeschGehG.

By far the most-read post was about damages in the millions for breach of an NDA (here). In second place on the popularity list was our article on a decision by the Schleswig Higher Regional Court with new considerations regarding appropriate protective measures (here). Third place goes to the post on a ruling by the Saxony Regional Labor Court regarding the implementation of a clean desk policy (here).
