Lecture on the German Act on the Protection of Trade Secret GeschGehG

Approximately two and a half years after the GeschGehG took effect, the first higher court decisions on the new law have been issued, and a case is pending before the Federal Court of Justice (BGH). A key focus of the initial rulings is the question of how the element of “appropriate protective measures” should be interpreted (see here). The application of the procedural provisions in Sections 16-20 of the GeschGehG remains largely unclear.
